Coming into force: 1st April 1991

The Secretary of State for Transport, in exercise of the powers conferred by sections 45 and 46 of the Road Traffic Act 1988[^f00001] and the Department of Transport (Fees) Order 1988[^f00002], and of all other enabling powers, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:

These Regulations may be cited as the Motor Vehicles (Tests) (Amendment) (No. 2) Regulations 1991 and shall come into force on 1st April 1991.

The Motor Vehicles (Tests) Regulations 1981[^f00003] shall be further amended in accordance with the provisions of these Regulations.

In the Regulations specified in column 1 of the Table below for the amounts specified in column 2 of the Table there shall be substituted the amounts specified in column 3 of the Table.

In Regulation 20(4) for the Table there shall be substituted the following Table—

Vehicles in Class VI constructed or adapted to carry more than 12 passengers a £20.00, if the vehicle is submitted for a further examination within 14 days of the date of the issue of the notice of refusal of a test certificate, or a £33.00 in the circumstances described in paragraph (a) of the entry in column 2, or
b £40.60 in any other case. b £66.60 in any other case
Other vehicles in Class VI a £ 14.20, it the vehicle is submitted for a further examination within 14 days of the date of the issue of the notice of refusal of a test certificate, or a £23.70, in the circumstances described in paragraph (a) of the entry in column 2, or
b £28.30, in any other case. b £47.40, in any other case.

Explanatory note

(This note is not part of the Regulations)

These Regulations amend the Motor Vehicles (Tests) Regulations 1981 (“the 1981 Regulations”) in relation to Class VI vehicles (Public Service Vehicles other than those of a type specified in regulation 5(3)) as follows.
