The Secretary of State for Education and Science, in exercise of thepowers conferred by sections 1 and 4(2) of, and paragraphs 3 and 4 ofSchedule 1 to, the Education Act 1962[^f00001] and section 3(1) and (3) of the Education Act 1973[^f00002], hereby makes the following Regulations:

Citation and commencement

These Regulations may be cited as the Education (Mandatory Awards)(Amendment) Regulations 1991 and shall come into force on 17th April1991.

Amendment of the Principal Regulations

The Education (Mandatory Awards) Regulations 1990[^f00003] shall be amended as follows—

“relevant territory” means the territory comprising the European Community and, asrespects any period prior to the unification of the Federal Republic ofGermany, the former German Democratic Republic;

(d) in the case of a student who before commencing his course wasresident in the former German Democratic Republic, or who has previouslyattended one or more courses of higher education the aggregate durationof which does not exceed two academic years (a part-time course beingtreated as its full- time equivalent), where the application reaches theauthority before 31st August 1991; or (e) where, having regard to the circumstances of the particular case,the authority consider that it should be so treated;

or in pursuance of any bursary bestowed on him under the Bursary Scheme for“Part 2” Architecture Course Students

Explanatory note

(This note is not part of the Regulations)

These Regulations, which come into force on 17th April 1991, amendthe Education (Mandatory Awards) Regulations 1990.

Residence in the former German Democratic Republic prior to theunification of the Federal Republic of Germany shall be treated asequivalent to residence in the European Community in assessing astudent’s entitlement to an award (Regulations 2, 5 and 13).

Regulation 11(2) has been amended to provide for late applicationsfrom students who before commencing their courses were resident in theformer German Democratic Republic, and from students who may be affectedby the amendment to regulation 12.

Regulation 12 has been amended so that previous attendance atcourses of higher education the duration of which does not exceed twoyears does not relieve an authority of its duty to bestow an award.

Regulation 13 has also been amended to provide that the requirementfor three years' ordinary residence in the British Islands does notapply to European students.

Regulation 23 has been amended to provide that a person who hasreceived a payment from the Architecture Bursary Scheme, which was setup following the de-designation of certain architecture courses, shallnot be entitled to a mandatory award in respect of the same yearfollowing the subsequent re-designation of those courses.

Regulation 24 has been amended to cover the case of institutionswhich have more or less than three terms.

The vacation hardship allowance has been abolished (Schedule 2,former paragraph 11).

Payments to a disabled student under paragraph 11(4) of Schedule 2may now be used to supplement payments made under 11(2) and (3).
