Made: 11th April 1991

Coming into force: 14th October 1991

The Secretary of State for Health, in exercise of the powers conferred by sections 87(6) and 104(4) of the Children Act 1989[^f00001] and of all other powers enabling him in that behalf hereby makes the following regulations:–

Citation, commencement and interpretation

Inspection of premises

An authorised person may inspect any premises or part of the premises used by any relevant independent school.

Inspection of children

unless the child is also attending the school as a pupil.

Inspection of records

in respect of all the children whom he has power to inspect pursuant to regulation 3 of these Regulations.

Explanatory note

(This note is not part of the regulations)

These regulations make provision for inspection by persons authorised by local authorities for the purposes of section 87(5) of the Children Act 1989 (welfare of children in independent schools) of the premises of independent schools, the children in them and records maintained in respect of them. Authorised persons may enter independent schools in exercise of the power conferred by section 87(5) of that Act.
