The Royal Cornwall Hospitals and West Cornwall Hospital National Health Service Trust (Change of Name) Order 1992

Made: 2nd June 1992

Coming into force: 9th June 1992

The Secretary of State for Health, in exercise of powers conferred by section 126(3) and (4) of the National Health Service Act 1977[^f00001] and section 5(1) of the National Health Service and Community Care Act 1990[^f00002] and of all other powers enabling her in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

• (1) This Order may be cited as the Royal Cornwall Hospitals and West Cornwall Hospital National Health Service Trust (Change of Name) Order 1992 and shall come into force on 9th June 1992.

• (2) In this Order unless the context otherwise requires—

• “the Order” means the Royal Cornwall Hospitals and West Cornwall Hospital National Health Service Trust (Establishment) Order 1991[^f00003]; and

• “the trust” means the Royal Cornwall Hospitals and West Cornwall Hospital National Health Service Trust established by the Order.

Change of name of NHS trust

The trust shall be called the Royal Cornwall Hospitals National Health Service Trust instead of the Royal Cornwall Hospitals and West Cornwall Hospital National Health Service Trust and accordingly in the definition of “the trust” in article 1(2) and in article 2 of the Order the words “and West Cornwall Hospital” shall be deleted.

Transitional provisions

The change of name under this Order shall not—

• (a) affect any right or obligation of any person;

• (b) be taken as invalidating any instrument (whether made before, on or after the day on which this Order comes into force) which refers to the trust by its previous name,

Explanatory note

(This note is not part of the Order)

This Order changes the name of an NHS Trust established by Order under Part I of the National Health Service and Community Care Act 1990 from the Royal Cornwall Hospitals and West Cornwall Hospital National Health Service Trust to the Royal Cornwall Hospitals National Health Service Trust and makes consequential amendments to the Order.
