The Secretary of State, in exercise of the powers conferred by section 26(3) of the Transport and Works Act 1992[^f00001] (hereinafter referred to as “the Act”) and of all other enabling powers, hereby makes the following Order:

Citation and commencement

This Order may be cited as the Transport (Guided Systems) Order 1992 and shall come into force on 7th December 1992.

Specified systems

The Secretary of State hereby specifies for the purposes of Chapter I of Part II of the Act the systems which use a mode of guided transport of which particulars are given in the Schedule to this Order.

Explanatory note

(This note is not part of the Order)

This Order specifies certain systems using modes of guided transport for the purposes of Chapter I of Part II of the Transport and Works Act 1992. The Order accordingly has the effect of applying to these systems the provisions of the Act which introduce new offences involving drink and drugs.

Particulars of the systems are given in the Schedule to the Order. One employs magnetic levitation; another a monorail; and three are track-based using side guidance. A definition of each of these terms appears in Article 3 of the Order.
