The Artificial Insemination of Pigs (EEC) Regulations 1992

The Minister of Agriculture, Fisheries and Food, in relation to England, the Secretary of State for Scotland in relation to Scotland and the Secretary of State for Wales in relation to Wales in exercise of the powers conferred on them by sections 10(1), (2) and (8) of the Animal Health and Welfare Act 1984[^f00001] and of all other powers enabling them in that behlaf, hereby make the following Regulations:

Title and commencement

These Regulations may be cited as the Artificial Insemination of Pigs (EEC) Regulations 1992 and shall come into force on 1st January 1993.

Intra-Community trade in porcine semen

• (1) No person shall collect, process, store or transport for the purpose of export to a member State and porcime semen unless it complies with article 3 of Council Directive 90/429/EEC laying down the animal health requirements applicable to intra-Community trade in and imports of semen of domestic animals of the pordine species[^f00002].

• (2) The appropriate Minister, upon being satisfied that a semen collection centre complies with the provisions of Council Directive 90/429/EEC (in particular Annex A thereof) shall, for the purposes of export of porcine semen to a member State—

• (a) approve the semen collection centre, and

• (b) issue the centre with a registration number.

• (3) The appropriate Minister may approve isolation accommodation for the purposes of Annex B to Council Directive 90/429/EEC.

• (4) Any premises approved under paragraph (2) or (3) above shall be supervised by a veterinary inspector appointed under the Animal Health Act 1981[^f00003] who shall report to the appropriate Minister any breach of any provision of the Directive.

• (5) Every approval granted under paragraph (2) or (3) above shall be in writing and may be withdrawn or suspended after notice in writing has been served on the person having charge of the collection centre or isolation accommodation informing him of the breach the Directive complained of.

• (6) It shall be the duty of a veterinary inspector appointed under the Animal Health Act 1981 to issue animal haelth certificates for the purposes of Council Directive 90/429/EEC.

• (7) Council Directive 90/429/EEC is to be read as follows—

• (a) as if the reference in Article 3—

• (i) to “Each Member State” were to “The appropriate Minister”;

• (ii) to “intra-Community trade” were to “trade within Great Britain”;

• (b) as if the reference in Article 5(1)—

• (i) in the first paragraph, to “Member State on whose territory” were to “appropriate Minister for the territory where”;

• (ii) in the second paragraph, to “Member State” were to “appropriate Minister”.

Disapplication

The Artificial Insemination of Pigs (England and Wales) Regulations 1964[^f00004] and the Artificial Insemination of Pigs (Scotland) Regulations 1964[^f00005] shall not apply to the collection, processing, storage and transport of porcine semen for the purpose of export to a member State.

Explanatory note

(This note does not form part of the Regulations)

These Regulations implement the provisions of Council Directive 90/429/EEC in relation to exports to member States and the approval of semen collection centres which engage in intra-Community trade in porcine semen. They disapply the Artificial Insemination of Pigs (England and Wales) Regulations 1964 and the Artificial Insemination of Pigs (Scotland) Regulations 1964 which continue to regulate the domestic trade in porcine semen.
