The Secretary of State, in exercise of the powers conferred on him by section 3(9) of the Town and Country Planning Act 1984[^f00001], section 273 of the Town and Country Planning (Scotland) Act 1972[^f00002] (as applied by section 6(4) of the Town and Country Planning Act 1984) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

These Regulations may be cited as the Town and Country Planning (Special Enforce ment Notices) (Scotland) Regulations 1992 shall come into force on 26th March 1992 and shall extend to Scotland only.

The provisions of the Town and Country Planning (Scotland) Act 1972[^f00002] specified in the Schedule to these Regulations shall apply to special enforcement notices and to appeals against such notices under section 3(7) of the Town and Country Planning Act 1984 as if the references in those provisions to an enforcement notice were references to a special enforcement notice and subject to the further modifications specified in that Schedule.

The Town and Country Planning (Special Enforcement Notices) (Scotland) Regulations 1984[^f00003] are hereby revoked.

SCHEDULE

Subsections (1) to (3) shall not apply.

In subsection (4) for the words “has control of or an interest in” substitute “occupies” and delete the words “(other than the owner)”.

In subsection (9) for the words “section 84 of this Act” substitute “section 3(6) of the Town and Country Planning Act 1984”.

In subsection (6)(b) delete “83C, 83D or”.

Explanatory note

(This note is not part of the Regulations)

These Regulations, which replace the Town and Country Planning (Special Enforcement Notices) (Scotland) Regulations 1984 following the commencement of the relevant provisions contained in the Planning and Compensation Act 1991, apply to special enforcement notices those provisions of the Town and Country Planning (Scotland) Act 1972 (as amended by the 1991 Act) which are specified in the Schedule to these Regulations subject to modification where appropriate. The Regulations make no substantive changes to the previous Regulations.
