Explanatory note

(This note is not part of the Regulations)

1 These Regulations re-enact with modifications the provisions of the Motor Vehicles (Type Approval and Approval Marks) (Fees) Regulations 1991 and enact provisions which replace the Agricultural and Forestry Tractors and Tractor Components (Type Approval) (Fees) (Amendment) Regulations 1992.

2 The Regulations prescribe the fees payable for the examination of vehicles and vehicle parts, the examination of complete vehicles and the issue of documents in connection with— 1 the type approval of vehicles and vehicle parts and the authorisation of the application of approval marks to vehicles and vehicle parts for the purposes of Community Instruments or ECE Regulations; and 2 the national scheme for the type approval of vehicles and vehicle parts established under sections 54 to 66 of the Road Traffic Act 1988, the Motor Vehicles (Type Approval) (Great Britain) Regulations 1984 (S.I. 1984/981) and the Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) Regulations 1982 (S.I.1982/1271).

3 In addition to minor drafting changes, the Regulations make the following changes of substance.

4 The principal changes relate to the fee amounts and to the inclusion in Schedule 1 of items relating to the type approval testing of agricultural or forestry tractor components. The overall change to the fees contained in these Regulations is an increase of approximately 13%, but this is applied in different ways with the result that some fees are increased, some are reduced and some remain in same.

5 In addition to changes to fee amounts, the introduction of new or amended ECE Regulations and new Community Instruments means that— 1 certain new fees relating to headlamps, strength of seats and anchorages for public service vehicles, and mechanical couplings have been added to Schedule 1; and 2 reference to those, as alternatives to existing ECE Regulations or Community Instruments—in relation to seat belts, seat belt anchorages, seat belt installation, rear view mirrors, engine power, fuel consumption, steering, forward field of vision, seats and anchorages and head restraints—appear for the first time.
