The Plant Passport (Plant Health Fees) (England and Wales) Regulations 1993

The Minister of Agriculture, Fisheries and Food in relation to England and the Secretary of State for Wales in relation to Wales in exercise of the powers conferred on them by section 56 of the Finance Act 1973[^f00001] and of all other powers enabling them in that behalf, with the consent of the Treasury, hereby make the following Regulations:
Citation and commencement

These Regulations may be cited as the Plant Passport (Plant Health Fees) (England and Wales) Regulations 1993 and shall come into force on 19th July 1993.
Interpretation

- (1) In these Regulations—
- “authority” means an authority to issue plant passports conferred on a business, individual or other organisation under Article 17 of the Plant Health (Great Britain) Order 1993[^f00002] and “plant passport” has the meaning assigned by article 2(1) of that Order.
- (2) Where a fee is prescribed in these Regulations in relation to an inspection for the purpose of the conferring of an authority to issue plant passports, the refusal to confer such an authority by reason of the results of the inspection being unsatisfactory shall not affect the amount of the fee payable.
Fees for inspections for plant passporting purposes

The fee specified in the Schedule to these Regulations shall be paid to the Minister of Agriculture, Fisheries and Food by the prospective holder or holder of the authority, in respect of any inspection (including a check of business records) for the purposes of conferring or maintaining an authority to issue plant passports.
SCHEDULE — FEES FOR INSPECTIONS FOR PLANT PASSPORTING PURPOSES
£17.50 for each quarter of an hour or part thereof spent on site by an inspector with a minimum of £35 in respect of any visit.

Explanatory note
(This note is not part of the Regulations)
These Regulations, which apply to England and Wales only, prescribe fees in respect of inspections carried out for the purpose of conferring authority to issue plant passports (including check of business records) under the Plant Health (Great Britain) Order 1993 (S.I. 1993/1320).
Under that Order, from 1st June 1993, certain listed plants, plant products and other objects will require a plant passport for movement within the European Community including any trade within the United Kingdom. Producers, traders and importers of such material must first be authorised to issue plant passports by the Minister of Agriculture, Fisheries and Food or the Secretary of State. The authorisation process involves an inspection of premises and the listed plant material and includes a check on business records.
This system replaces within the European Community the previous system of issue of phytosanitory certificates which were required to accompany exports of certain plants, plant products etc.
The fees prescribed by these Regulations are charged at an hourly rate calculated to reflect the costs expected to be incurred in undertaking the inspections.
