In exercise of the powers conferred on the Secretary of State by sections 16A(2) and 63(3) of the Education (No. 2) Act 1986[^f00001] and sections 89(1A) and 232(5) of the Education Reform Act 1988[^f00002] the Secretary of State for Education, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Regulations:

Explanatory note

(This note is not part of the Regulations)

These Regulations prescribe the circumstances in which the governing bodies of county, voluntary, maintained special or grant-maintained schools may provide further education in rooms where pupils are being taught. They prescribe that they may do so when a teacher is present.
