In exercise of the powers conferred on the Secretary of State by Sections 22 and 232(5) and (6) of the Education Reform Act 1988[^f00001], and Sections 16 and 19(3) of the Education (Schools) Act 1992[^f00002], and after consulting with those persons with whom consultation appeared to him to be desirable, the Secretary of State for Wales hereby makes the following Regulations:

PART I — GENERAL

The duties imposed on head teachers, governors and a local education authority by virtue of these Regulations in respect of the provision or publication of information apply only to the extent that information is available to the head teachers, governors or the local education authority before the latest occasion on which the information is required to be provided or published, as the case may be.

PART II — PROVISION OF INFORMATION BY HEAD TEACHER

Provision of information by head teacher to governing body

The head teacher of every maintained secondary school shall each year make available to the governors information about the matters relating to the school mentioned in Schedules 1 and 2 to these Regulations for the purpose of enabling the governors to comply with their obligations under these Regulations.

PART III — PROVISION OF INFORMATION TO THE SECRETARY OF STATE

Provision of background information relating to schools to the Secretary of State

The governing body of every maintained secondary school and the proprietor of every non-maintained special school and the proprietor of every independent school shall, within two weeks of receiving a written request from the Secretary of State, provide him with such background information relating to the school as is referred to in Part VI of Schedule 1.

Provision of results of school examinations to the Secretary of State

The governing body of every maintained secondary school and the proprietor of every non-maintained special school and the proprietor of every independent school shall, within two weeks of receiving a written request from the Secretary of State provide him with the information relating to public examinations for which pupils aged 15, 16, 17 or 18 registered at the school were entered during the reporting school year together with the other information which is referred to—

Maintained secondary schools prospectus: Examination results information

Where the information relating to public examination results which is published by the governing body of a maintained secondary school pursuant to section 58(5)(j) of the 1988 Act does not relate to examinations of the reporting school year, the governing body shall as soon as practicable after the information in question for the reporting school year is made available to them publish that information as a supplement to the school prospectus in the manner required by the school’s articles of government for publication of the prospectus provided that the information shall be published not later than two weeks before the date by which an application should be made for admission to the school in the school year following the school year in which the information relating to the reporting school year should be published.

Provision of local and national performance information relating to pupils aged 15, 16, 17 and 18 by governing bodies and by local education authorities

Avoidance of duplication of information in certain circumstances

Nothing in these Regulations shall require a head teacher, governing body or proprietor to make the same published particulars available to any person on more than one occasion, nor to make available to any person particulars which have already been made available to that person.

SCHEDULE 1 — INFORMATION TO BE PROVIDED BYTHE HEAD TEACHER TO THE GOVERNING BODY ANDINFORMATION TO BE PROVIDED BY THE GOVERNING BODYOR PROPRIETOR TO THE SECRETARY OF STATE

Part I: — GCSE and CoE Summaries

The number of male pupils aged 15 registered at the school, the number of female pupils aged 15 registered at the school and the total number of pupils aged 15 registered at the school in the reporting school year.

For the reporting school year and the previous school year the percentage of male pupils, the percentage of female pupils and the percentage of all pupils referred to in paragraph 1 above who—

For the reporting school year and the previous school year the percentage of male pupils, the percentage of female pupils and the percentage of all pupils referred to in paragraph 2 above whose achievements fall into each of the following ranges of points as determined by paragraph (5) of regulation 4, namely; 0 to 4 points, 5 to 9 points and 10 to 15 points.

For the reporting school year and the previous school year the average number of points, as referred to in paragraph 3, achieved by male pupils, female pupils and all pupils referred to in paragraph 2 above.

The number of male pupils, the number of female pupils and the number of all pupils referred to in paragraph 1 above who were entered for two or more GCE ‘A’ level examinations or the GCE ‘AS’ level examination equivalent.

For the reporting school year and the previous school year the percentage of male pupils, the percentage of female pupils and the percentage of all pupils referred to in paragraph 5 above whose achievements fall into each of the following ranges of points, as determined by paragraph (5)of regulation 4, namely; 0 points, 1 to 4 points, 5 to 9 points, 10 to 14 points, 15 to 19 points,20 to 24 points, 25 to 29 points and 30 points or more.

The average number of points, as referred to in paragraph 6, achieved by male pupils, female pupils and all pupils referred to in paragraph 5 above.

The matters mentioned in Schedule 1, together with the corresponding local figures and corresponding national figures provided by the Secretary of State where available.

The matters mentioned in paragraphs 3 and 4 of Schedule 2.

Part II: — Information to be published in the school prospectus

The matters mentioned in Schedule 1 Parts I, II, III and V for pupils only, together with the corresponding local figure and corresponding national figure provided by the Secretary of State where available.

The matters mentioned in paragraphs 1 and 2 of Schedule 2.

Explanatory note

(This note is not part of the Regulations)

These Regulations, made under Sections 22 and 232(5) and (6) of the Education Reform Act 1988 and Sections 16 and 19(3) of the Education Reform Act 1992 apply to schools in Wales (regulation 1)

Regulation 2 revokes the previous Regulations, The Education (School Performance Information) (Wales) Regulations 1992[^f00008].
