Made: 6th December 1993

Coming into force:

The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred by section 37(1) of the Animal Health Act 1981[^f00001] and of all other powers enabling them in that behalf, hereby make the following Order:

Title and commencement

This Order may be cited as the Welfare of Animals at Markets (Amendment) Order 1993 and shall come into force on 1st January 1994, except for article 2(2) which shall come into force on 1st January 1995.

Amendments to the Welfare of Animals at Markets Order

(5A) No person shall bring to a market, or allow to be exposed for sale in a market, a lamb or goat kid with an unhealed navel.

(6A) The market operator shall ensure that any lamb aged under 4 weeks (other than a lamb which is at the foot of its dam) and any goat kid aged under 4 weeks is removed from the market without undue delay, and in any event not more than 4 hours after arrival.

; and (c) the bedding provided under this provision is dry at the time it is provided.

(3) It shall be the duty of the market authority of every market in which lambs under 4 weeks old (other than lambs at the foot of their dams) or goat kids under 4 weeks old are kept to provide solid sided draught free pens for such animals. (4) It shall be the duty of the market operator to ensure that any such lamb (other than a lamb which is at the foot of its dam) or goat kid is kept in the accommodation provided in accordance with the preceding paragraph.

(c) stating that, during the previous 28 days, the calf has not, or as the case may be, has only once, been brought to a market; and

Explanatory note

(This note is not part of the Order)

This Order amends the Welfare of Animals at Markets Order 1990 (S.I. 1990/2628) by making further provisions for the protection of lambs and kids at market and making a minor clarification to article 14(3)(c).

A Compliance Cost Assessment has been prepared and a copy has been placed in the library of the House.
