The A249 Trunk Road (M2 to Bobbing Improvement) Order 1993
Made: 18th February 1993
Coming into force: 23rd March 1993
The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 41 of the Highways Act 1980[^f00001], and now vested in him[^f00002], and of all other enabling powers:—

The new highways which the Secretary of State proposes to construct along the routes described in the Schedule to this Order shall become trunk roads as from the date when this Order comes into force.

The centre line of each of the new trunk roads is indicated by a heavy black line on the deposited plan.

The Secretary of State directs as respects any part of a highway which crosses the route of a new trunk road that—
- (a) where the highway is a highway maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority, and
- (b) where the highway is not a highway so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question,
until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the relevant route is opened for the purpose of through traffic.

In this Order—
- (1) all measurements of distance are measured along the route of the relevant highway;
- (2)
- (i) “the deposited plan” means the plan numbered PSE/O/A249/4/65/10/2 marked “The A249 Trunk Road (M2 to Bobbing Improvement) Order 1993” signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;
- (ii) “the new trunk roads” means the highways mentioned in article 1 of this Order and “a new trunk road” means one of those highways;
- (iii) “the trunk road” means the A249 Trunk Road.

This Order shall come into force on 23rd March 1993 and may be cited as the A249 Trunk Road (M2 to Bobbing Improvement) Order 1993.
THE SCHEDULE — ROUTES OF THE NEW TRUNK ROADS
The routes of the new trunk roads are near Danaway and Key Street, near Sittingbourne, in the County of Kent, and are as follows—

A route about 2.09 kilometres in length starting at and including a roundabout on the site of the existing roundabout junction between the A249 and the M2 (at Stockbury Valley) and proceeding northeastwards, passing northwest of Danaway, to a point on the trunk road 580 metres northeast of its junction with Wormdale Hill, the new trunk road along this route being labelled A on the deposited plan.

A route about 1.27 kilometres in length starting at a point on the trunk road 20 metres south of its roundabout junction with the A2 (at Key Street) and proceeding northeastwards to a point on the road to be constructed by the Secretary of State in pursuance of the A249 Iwade Bypass Order 1992[^f00003] (described in paragraph 1 of the Schedule to that Order), 500 metres northeast of its crossing of the London—Sittingbourne railway and just northeast of Bobbing County Primary School, the new trunk road along this route being labelled B on the deposited plan.
