Explanatory note

(This note is not part of the Regulations)

1 These Regulations re-enact with modifications the provisions of the Motor Vehicles (Type Approval and Approval Marks) (Fees) Regulations 1992.

2 The Regulations prescribe the fees payable for the examination of vehicles and vehicle parts, the examination of complete vehicles and the issue of documents in connection with– a the type approval of vehicles and vehicle parts and the authorisation of the application of approval marks to vehicles and vehicle parts for the purposes of Community Instruments or ECE Regulations; and b the national scheme for the type approval of vehicles and vehicle parts established under sections 54 to 66 of the Road Traffic Act 1988, the Motor Vehicles (Type Approval) (Great Britain) Regulations 1984 (S.I. 1984/981) and the Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) Regulations 1982 (S.I. 1982/1271).

3 In addition to minor drafting changes, the Regulations make the following changes of substance.

4 The principal changes relate to the fee amounts and to the inclusion of fees in connection with activities related to the examination, and issue of certificates, for: a European whole vehicle type approval at regulations 8 and 10, and in Schedules 2 and 5; and, b low volume type approval in regulation 7, 10 and 11, and in Schedules 2 and 5. The overall change to the fees contained in these Regulations is an increase of approximately 2%, but this is applied in different ways with the result that some fees are increased, some are reduced and some remain the same.

5 In addition to changes to fee amounts, fees for the consideration of any changes in detail to vehicles issued with national type approval certificates have been introduced as follows: a Regulation 11 imposes a charge payable for goods vehicles and low volume type approval vehicles, of a type subject to a Minister’s approval certificate, payable where a change occurs in relation to the issue of,– i the first sub-MAC (as defined) applied for in each year after the year in which the first Minister’s approval certificate is issued, for NI category vehicles; ii each sub-MAC applied for, where the vehicle is in category N2 or N3; iii in the case of a low volume type approval vehicle, the first sub-MAC applied for in each year after the year in which the first Minister’s approval certificate is issued and at the same time as the 200th such certificate is issued in any year; and b Regulation 16(2) introduces a charge for N1 category vehicles of a model issued with a type approval certificate, payable upon the manufacturer informing the Secretary of State of a design change pursuant to a condition attached to the certificate.

6 An hourly fee is introduced, at regulation 17, for the examination of premises with a view to them being approved for the purposes of carrying out examinations in accordance with a type approval scheme, or a Community Instrument, or an ECE Regulation.

7 A further hourly fee is introduced, at regulation 18, for advising a manufacturer whether his arrangements for securing conformity of production are likely to be accepted by the Secretary of State.

8 Additionally, the introduction of new or amended ECE Regulations and new Community Instruments means that– a certain new fees relating to motorcycle and moped exhaust emissions, motorcycle brakes, steering of goods vehicles, identification of motorcycle controls, measurement of maximum speed, speed limiters, and vehicle masses and dimensions have been added to Schedule 1; and b reference to those, as alternatives to existing ECE Regulations or Community Instruments — in relation to safety glass, exhaust emissions from both petrol and diesel engines, braking devices, tyres, seat belt anchorages, and lighting installation– appear for the first time.
