References to Community Instruments

(1) A reference in Schedule 1 to an expression shown in column 1 of Part II of this Schedule (all of which begin with the word “Directive”) shall be read as follows.

(2) If a single Council or Commission Directive is shown in column 2 of that Part against the expression, the reference shall be read as a reference to that Directive, details of which are shown in columns 3 and 4.

(3) If more than one Council or Commission Directive is shown in column 2 of that Part against the expression, the reference shall be read as a reference to the first Directive as amended by the other Directive or Directives so shown.

(4) “(CL)” after a Directive shown in column 2 indicates that the Directive is a Council Directive and “(CM)” after the Directive indicates that the Directive is a Commission Directive.

(1) A reference in Schedule 1 to an ECE Regulation followed by a number which is not itself followed by a full stop and two digits (for example “ECE Regulation 8”) shall be read as a reference to the ECE Regulation of that number.

(2) A reference in Schedule 1 to an ECE Regulation followed by a number which is itself followed by a full stop and two digits (for example “ECE Regulation 8.04”) shall be read as a reference to the ECE Regulation of that number with the amendments in force on the date shown against the number in column (2) of Part IV of this Schedule.

2 The Regulations prescribe the fees payable for the examination of vehicles and vehicle parts, the examination of complete vehicles and the issue of documents in connection with— a the type approval of vehicles and vehicle parts and the authorisation of the application of approval marks to vehicles and vehicle parts for the purposes of Community Instruments or ECE Regulations; and b the national scheme for the type approval of vehicles and vehicle parts established under sections 54 to 66 of the Road Traffic Act 1988, the Motor Vehicles (Type Approval) (Great Britain) Regulations 1984 (S.I. 1984/981) and the Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) Regulations 1982 (S.I. 1982/1271).

3 In addition the Regulations prescribe the fees payable for— a the examination of premises with a view to their being approved for the purposes of carrying out examinations in accordance with a type approval scheme, a Community Instrument or an ECE Regulation; and b advising a manufacturer whether his arrangements for securing conformity of production are likely to be accepted by the Secretary of State.

4 In addition to minor drafting changes, the Regulations make the following changes of substance.

5 The principal changes relate to the fee amounts but these changes do not result in an overall percentage increase. However, some fees are increased, some are reduced and some remain the same.

6 An additional charge is introduced for work carried out in the U.S.A., Canada or Mexico by a person who is resident in the U.S.A. and acting for or on behalf of the Secretary of State.

7 The introduction of new or amended ECE Regulations and new Community Instruments means that— a certain new fees relating to vehicle noise, protective steering of passenger cars and electrical power connections of agricultural vehicles have been added to Schedule 1; and b alternatives to existing ECE Regulations or Community Instruments in relation to external projections, speed limiters, fuel consumption, exhaust emissions, braking devices, side rear and stop lamps, controls tell-tales and indicators, anti-theft devices and identification of controls— appear for the first time.
