Made: 31st January 1994

Laid before Parliament: 9th February 1994

Coming into force: 2nd March 1994

having consulted the committee established under section 140(5) of the Environmental Protection Act 1990[^f00001];

having published notices in pursuance of section 140(6)(b) of that Act;

having considered any representations made to them in accordance with the notices;

considering it appropriate to make these Regulations for the purpose of preventing the articles specified in them from causing pollution of the environment;

in exercise of the powers conferred on them by section 140(1), (2), (3)(b) to (d) and (9) of the Environmental Protection Act 1990, and of all other powers enabling them in that behalf, hereby make the following Regulations:—

“authorised person” means a person authorised by—

for any purpose of these Regulations;

Prohibition of importation, landing and unloading

Prohibition of supply

No person shall, other than for the purposes of research and development or analysis, or for export, supply a non-refillable refrigerant container.

Prohibition of storage

Powers of the Secretary of State

The Secretary of State may require a person who has imported, landed or unloaded a non-refillable refrigerant container in contravention of regulation 3—

and such a person shall comply with that requirement.

shall be guilty of an offence and shall be liable, on summary conviction, to a fine not exceeding level 5 on the standard scale.

Explanatory note

(This note is not part of the Regulations)

These Regulations impose restrictions on the importation, supply and storage ofnon-refillable containers containing certain chlorofluorocarbons (CFCs) and hydrochlorofluorocarbons (HCFCs) for use as refrigerants in air-conditioning and refrigeration machinery.

Regulation 3 (which applies to the United Kingdom) bans the import, landing and unloading of such containers and regulations 4 and 5 (which apply to Great Britain only) ban their supply and storage. Exceptions are made for certain specified purposes. Regulations 6 and 7 contain enforcement powers. Regulation 8 makes it a criminal offence to contravene the bans imposed by regulations 3 to 5 or to fail to comply with enforcement requirements.
