The Secretary of State for Health, in exercise of powers conferred on her by section 126(3) of the National Health Service Act 1977[^f00001]and section 5(1) of the National Health Service and Community Care Act 1990[^f00002]hereby makes the following Order:

In the Order—

(2) Since the trust is to be regarded as having a significant teaching and research commitment within the meaning of paragraph 3(1)(d) of Schedule 2 to the act, one of the non-executive directors shall be appointed from the University of Birmingham.

Explanatory note

(This note is not part of the Order)

This Order amends the East Birmingham Hospital National Health Service Trust (Establishment) Order 1991, which established the NHS trust now known as the Birmingham Heartlands Hospital National Health Service Trust, by inserting provisions for the Trust to have a non-executive director appointed from a University.
