The Powys Health Care National Health Service Trust (Transfer of Trust Property) Order 1995

The Secretary of State for Wales, in exercise of the powers conferred on him by section 92(1) of the National Health Service Act 1977[^f00001] and of all other powers enabling him in that behalf, having regard to the change in the arrangements for the administration of hospitals and other establishments and facilities formerly managed by the Powys Health Authority resulting from the establishment of the Powys Health Care National Health Service Trust [^f00002], having consulted that Authority and that Trust in accordance with section 92(3) of that Act, hereby makes the following Order:

Citation, commencement and interpretation

• (1) This Order may be cited as the Powys Health Care National Health Service Trust (Transfer of Trust Property) Order 1995 and shall come into force on 31st May 1995.

• (2) In this Order:

• “the Authority” means the Powys Health Authority;

• “the Trust” means the Powys Health Care National Health service Trust;

• “the trust property” means the items specified in a schedule of trust property prepared by and agreed upon by the authority and the trust on 16th March 1995, which schedule has been signed on behalf of both the Authority and the Trust

Transfer of trust property

On 31st May 1995 the trust property shall be transferreed from the Authority to the Trust.

Explanatory note

(This note is not part of the Order)

This Order transfers to the Powys Health Care National Health Service Trust on 31st May 1995 trust property formerly held by the Powys Health Authority. A copy of the schedule of trust property to which the Order refers can be obtained fromn Welsh Office, HFM3, New Crown Building, Cathays Park, Cardiff CF1 3NQ.
