The A629 Trunk Road (Skipton To Kildwick Improvement and Slip Roads) Order 1996

Made: 1st April 1996

Coming Into Force: 26th April 1996

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 41 of the Highways Act 1980[^f00001] and now vested in him[^f00002] and of all other powers enabling him on their behalf:

The new highways which the Secretary of State proposes to construct—

• (a) along the route described in the Schedule to this Order (the highway along this route being in the Order referred to as “the main new trunk road”); and

• (b) along the routes described in the Schedule to this Order which connect the main new trunk road with other highways at the places stated in that Schedule (the highways along these routes being in this Order referred to as “the slip roads”),

shall become trunk roads from the date when this Order comes into force.

The centre line of each of the new trunk roads is indicated by a heavy black line on the deposited plan.

The Secretary of State directs as respects any part of a highway which crosses the route of any of the new trunk roads that—

• (a) where the highway is a highway maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority, and

• (b) where the highway is not a highway so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question,

until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the new trunk roads are opened for the purposes of through traffic.

In this Order—

• (1) all measurements of distance are measured along the route of the relevant highway;

• (2)

• (i) “the deposited plan” means the plan numbered HA10/NOD 372 marked “The A629 Trunk Road (Skipton to Kildwick Improvement and Slip Roads) Order 1996” signed by the authority of the Secretary of State and deposited at the Department of Transport, Romney House, Marsham Street, London SW1P 3PY;

• (ii) “the main new trunk road” means the new highway which the Secretary of State proposes to construct along the route described in Schedule 1 to this Order;

• (iii) “the new trunk roads” means the main new road and slip roads;

• (iv) “the slip roads” means the new highways which the Secretary of State proposes to construct along the routes described in Schedule 2 to this Order and which connect the main new road with other highways at the places stated in the Schedule; and

• (v) “the trunk road” means the North-West of Doncaster to Kendal Trunk Road (A629)

This Order shall come into force on 26th April 1996 and may be cited as the A629 Trunk Road (Skipton to Kildwick Improvement and Slip Roads) Order 1996.

SCHEDULE 1 — ROUTE OF THE MAIN NEW TRUNK ROAD

The route of the main new trunk road is about 4.1 kilometres in length, and extends from its junction with Snaygill Roundabout (marked A on the deposited plan) in a southerly direction to its junction with Kildwick Roundabout (marked B on the deposited plan, all in the District of Craven in the County of North Yorkshire.

SCHEDULE 2 — ROUTES OF THE SLIP ROADS

The routes of the slip roads are in the vicinity of Bradley and Cononley in the District of Craven.

One route to connect the southbound carriageway of the main new trunk road with Ings Lane, Bradley (marked 1 on the deposited plan), one route to connect the northbound carriageway of the main new trunk road with Cononley Lane (marked 2 on the deposited plan) one route to connect the southbound carriageway of the main new trunk road with the new Skipton Road (marked 3 on the deposited plan).
