The Maximum Number of Stipendiary Magistrates Order 1996

At the Court at Buckingham Palace, the 23rd day of July 1996 Present, The Queen’s Most Excellent Majesty in Council

Now, therefore, Her Majesty, in the exercise of the powers conferred on Her by section 13(4) of the Justices of the Peace Act 1979, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

Citation, commencement and interpretation

• (1) This Order may be cited as the Maximum Number of Stipendiary Magistrates Order 1996 and shall come into force on the day after the day on which it is made.

• (2) In this Order—

• (a) “stipendiary magistrate” means a stipendiary magistrate appointed under section 13 of the 1979 Act in any commission area or areas outside the inner London area and the City of London;

• (b) “the 1979 Act” means the Justices of the Peace Act 1979.

Maximum number

The maximum number of stipendiary magistrates specified for the purposes of section 13(4) of the 1979 Act shall be fifty.

Explanatory note

(This note is not part of the Order)

This Order in Council provides for the maximum number of stipendiary magistrates (other than metropolitan stipendiary magistrates) appointed under the Justices of the Peace Act 1979 to be raised from forty to fifty.
