The Education (Pupil Referral Units) (Application of Enactments) (Amendment) Regulations 1996

In exercise of the powers conferred upon the Secretary of State by sections 298(8) and 301(6) of, and paragraph 3 of Schedule 18 to, the Education Act 1993[^f00001], the Secretary of State for Education and Employment, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Regulations:

Citation, commencement and interpretation

• (1) These Regulations may be cited as the Education (Pupil Referral Units) (Application of Enactments) (Amendment) Regulations 1996 and shall come into force on 1st September 1996.

• (2) In these Regulations a reference to the principal Regulations is a reference to the Education (Pupil Referral Units) (Application of Enactments) Regulations 1994[^f00002].

Amendment of principal Regulations

• (1) In Part 1 of Schedule 1 to the principal Regulations the following paragraph is inserted after paragraph 3—

(3A) Section 9 of the Education (Schools) Act 1992[^f00003] applies in relation to units as if they were schools mentioned in subsection (3) of that section.

• (2) In Part II of Schedule 1 to the principal Regulations for paragraphs 7 and 8 there are substituted the following paragraphs—

(7) Parts I and II of the Education (School Inspection) (Wales) (No. 2) Regulations 1993[^f00004] apply in relation to a unit with the modification that in regulation 4 for paragraph (a) there is substituted the following paragraph (a) on or after 1st September 1996 but before 1st August 2001; (8) Parts I and II of the Education (School Inspection) (No. 2) Regulations 1993[^f00005] apply in relation to a unit with the modification that in regulation 4 for paragraph (a) there is substituted the following paragraph— (a) on or after 1st September 1996 but before 1st August 2000;

Explanatory note

(This note is not part of the Regulations)

The Education (Pupil Referral Units) (Application of Enactments) Regulations 1994 ( “the principal Regulations”) amongst other things provide for the enactments listed in Schedule 1 to the Regulations to apply, modified as required by that Schedule, to pupil referral units. These Regulations amend Schedule 1 to the principal Regulations to apply section 9 of the Education (Schools) Act 1992 (inspection of schools), and related subordinate legislation, to pupil referral units with the modifications set out in the Regulations.
