Whereas provision is made in relation to East Surrey Water plc (“East Surrey”) and The Sutton District Water Plc (“Sutton”) in local statutory provisions;

And whereas with effect from 1st April 1996 the Director General of Water Services has made a variation under section 8 of the Water Industry Act 1991[^f00001] replacing Sutton as a water undertaker;

And whereas by virtue of that variation East Surrey will hold an appointment as the water undertaker for the whole of the area for which East Surrey and Sutton each hold appointments as water undertakers;

And whereas with effect from 1st April 1996 Sutton will transfer properties, rights and liabilities to East Surrey by a transfer scheme under Schedule 2 to the Water Industry Act 1991;

And whereas it appears to the Secretary of State appropriate for the purposes of the above-mentioned variation and transfer scheme that provision be made corresponding to provisions originally made by Schedule 26 to the Water Act 1989[^f00002] and that local statutory provisions relating to East Surrey and Sutton be amended or repealed;
