The National Health Service Trusts (Appointment of Trustees) (Scotland) Order 1999

Coming into force: 9th April 1999

The Secretary of State, in exercise of the powers conferred on him by section 12G(2) of the National Health Service (Scotland) Act 1978¹, and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

• (1) This Order may be cited as the National Health Service Trusts (Appointment of Trustees) (Scotland) Order 1999, and shall come into force on 9th April 1999.

• (2) In this Order–

• “the Act” means the National Health Service (Scotland) Act 1978;

• “the Trust” means each of the National Health Service Trusts specified in Schedule 1 to this Order.

Appointment of trustees

The chairman, non-executive directors and executive directors of each respective Trust are appointed trustees ex officiis for the purpose of holding any property which is to be held in trust on behalf of that Trust under section 12G of the Act.

Revocations

The Regulations specified in Schedule 2 to this Order are hereby revoked.

Explanatory note

(This note is not part of the Order)

This Order appoints the chairman, non-executive directors and executive directors and their successors in office of each of the National Health Service Trusts specified in Schedule 1 to the Order as trustees for the purposes of holding any property which is to be held in trust on behalf of that Trust.
