Coming into force in accordance with article 1

The Secretary of State, in exercise of the powers conferred on him by sections 56(2), 112(1) and 113 of the Scotland Act 1998[^f00001] and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

This Order may be cited as the Scotland Act 1998 (Concurrent Functions) Order 1999 and shall come into force on the principal appointed day[^f00002].

Section 1(3), (4) and (6) of the Sea Fish (Conservation) Act 1967[^f00004] (size limits for fish carried by fishing boat). So far as exercisable—in relation to British fishing boats, but not Scottish fishing boats, within the Scottish zone; andin relation to Scottish fishing boats within British fishery limits but outside the Scottish zone.
Section 3(1), (3) and (4) of the Sea Fish (Conservation) Act 1967 (regulation of nets and other fishing gear). Section 4A of the Sea Fish (Conservation) Act 1967[^f00006] (licensing of vessels receiving trans-shipped the fish). So far as exercisable in relation to Scottish fishing boats within British fishery limits but outside Scottish zone.
Section 5 of the Sea Fish (Conservation) Act 1967[^f00007] (power to restrict fishing for sea fish). So far as exercisable—in relation to British fishing boats, but not Scottish fishing boats, within the Scottish zone; andin relation to Scottish fishing boats within British fishery limits but outside the Scottish zone.
Section 15(3) of the Sea Fish (Conservation) Act 1967[^f00008] (order by Ministers as to powers of British sea-fishery officers for enforcement of the Act). So far as exercisable—in relation to British fishing boats, but not Scottish fishing boats, within the Scottish zone; andin relation to Scottish fishing boats within British fishery limits but outside the Scottish zone.
Section 4 of the Agriculture (Miscellaneous Provisions) Act 1968[^f00009] (expenditure on free advice on the welfare of livestock). Not in relation to brucellosis, brucellosis meletensis tuberculosis or infestation of cattle with the maggot of the warble fly.
Section 5(1) and (2)(a) of the Sea Fisheries Act 1968[^f00010] (regulation of conduct of fishing operations). So far as exercisable—in relation to British fishing boats, but not Scottish fishing boats, within the Scottish zone; andin relation to Scottish fishing boats within British fishery limits but outside the Scottish zone.
Section 7(1)(g) and (2) of the Sea Fisheries Act 1968 (appointment of British sea-fishery officers).
Section 3 of the Animal Health Act 1981[^f00011], (expenditure for eradication). Not in relation to brucellosis, brucellosis meletensis tuberculosis or infestation of cattle with the maggot of the warble fly.
Section 5 of the Animal Health Act 1981 (veterinary services and therapeutic substances). Not in relation to brucellosis, brucellosis meletensis tuberculosis or infestation of cattle with the maggot of the warble fly.
Section 10 of the Animal Health Act 1981, (importation) as read with Schedule 2 (specific matters with respect to which provision may be made in orders under section 10). Not in relation to brucellosis, brucellosis meletensis tuberculosis or infestation of cattle with the maggot of the warble fly

Section 34 of the Animal Health Act 1981 (slaughter and compensation generally). Not in relation to brucellosis, brucellosis meletensis, tuberculosis or infestation of cattle with the maggot of the warble fly.
Section 35 of the Animal Health Act 1981 (seizure and disposal of carcasses etc.). Not in relation to brucellosis, brucellosis meletensis, tuberculosis or infestation of cattle with the maggot of the warble fly.

Explanatory note

(This note is not part of the Order)

This Order provides that certain functions transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46) shall be exercisable by a Minister of the Crown as well as by the Scottish Ministers.

Article 3 (1) and (2) of the Order provides that the functions described in Column 1 of Schedule 1 to the Order, in certain cases to the extent specified in Column 2 of that Schedule, shall be exercisable by the person by whom it was exercisable immediately before that transfer as well as by the Scottish Ministers.

Article 3 (3) provides that the functions described in Schedule 2 to the Order shall be exercisable by a Minister of the Crown as well as by the Scottish Ministers.

This Order will come into force on the principal appointed day. That day is currently 1st July 1999 by virtue of the Scotland Act 1998 (Commencement) Order 1998 (S.I. 1998/3178).
