Coming into force: 19th April 1999

The Secretary of State, being a Minister designated[^f00001] for the purposes of subsection (2) of section 2 of the European Communities Act 1972[^f00002] in relation to the operation of a Community eco-label award scheme, in exercise of the powers conferred on him by that subsection and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement

These Regulations may be cited as the United Kingdom Ecolabelling Board (Abolition) Regulations 1999 and shall come into force on 19th April 1999.

Interpretation

In these Regulations “the Board” means the body corporate established by regulation 2(1) of the United Kingdom Ecolabelling Board Regulations 1992[^f00003].

Abolition of the Board

The Board is hereby abolished.

Designation of the Secretary of State as competent body

The Secretary of State shall be the body in the United Kingdom responsible for carrying out the tasks of the competent body provided for in Council Regulation (EEC) No. 880/92[^f00004].

Transfer of property, rights and liabilities

All the property, rights and liabilities to which the Board is entitled or subject immediately before the date on which these Regulations come into force are transferred on that date to the Secretary of State for the Environment, Transport and the Regions.

Provision for continuity in exercise of functions

Anything duly done by, or any request or decision duly made by, the Board is deemed to have been duly done by, or made by, the Secretary of State.

Superannuation Act 1972

In Schedule 1 to the Superannuation Act 1972[^f00006] (bodies whose employees etc. may be covered by superannuation schemes), under the heading “Other bodies” the entry “United Kingdom Ecolabelling Board” is omitted.

Revocation of the United Kingdom Ecolabelling Board Regulations 1992

The United Kingdom Ecolabelling Board Regulations 1992 are hereby revoked.

Explanatory note

(This note is not part of the Regulations)

These Regulations abolish the United Kingdom Ecolabelling Board, which was the competent body for the United Kingdom for the purposes of Council Regulation (EEC) No. 880/92 of 23rd March 1992 on a Community eco-label award scheme, and therefore responsible in the United Kingdom for the award of labels to products which have a reduced environmental impact during their entire life cycle. Under these Regulations, the Secretary of State replaces the Board as the competent body and other consequential provision is made. The United Kingdom Ecolabelling Board Regulations 1992 are revoked.
