• (h) the Northern Ireland Central Services Agency for the Health and Social Services established under Article 26 of the Health and Personal Social Services (Northern Ireland) Order 1972;

• (i) the Northern Ireland Blood Transfusion Service Agency;

• (j) the Health Protection Agency established by section 1 of the Health Protection Agency Act 2004 ;

• (k) the Northern Ireland Regional Medical Physics Agency;

• (l) the Food Standards Agency;

• (m) the Health and Safety Executive for Northern Ireland;

• (n) a harbour authority, within the meaning of section 46(1) of the Aviation and Maritime Security Act 1990 , in Northern Ireland;

• (o) the Northern Ireland Transport Holding Company (established by the Transport Act (Northern Ireland) 1967 );

• (p) Ulsterbus Limited;

• (q) Citybus Limited;

• (r) Northern Ireland Railways Company Limited

• (s) a person holding a licence granted under Article 10(1)(b) of the Electricity (Northern Ireland) Order 1992 ;

• (t) a person holding a licence granted under Article 8(1) of the Gas (Northern Ireland) Order 1996 .

Joint discharge of functions etc.

Each general Category 1 responder which has functions which are exercisable in Northern Ireland may –

• (a) make arrangements with a body specified in paragraph (4) of regulation 57 to perform a duty of the general Category 1 responder under section 2(1) jointly with that body;

• (b) make arrangements with such a body for that body to perform such a duty on behalf of the general Category 1 responder.

• (1) Subject to regulations 45 to 53, general responders may disclose information on request to another general responder in connection with the performance by either of a function under the Act which relates to emergencies.

• (2) In relation to the Chief Constable of the Police Service of Northern Ireland, “emergencies” means an emergency falling within section 1(1)(c).

Part 11 — Review

• (1) Before the end of the review period, the Minister for the Cabinet Office must—

• (a) carry out a review of these Regulations;

• (b) set out the conclusions of the review in a report; and

• (c) lay the report before Parliament.

• (2) The report must in particular—

• (a) set out the objectives intended to be achieved by the regulatory system established by these Regulations;

• (b) assess the extent to which those objectives are achieved; and

• (c) assess whether those objectives remain appropriate and, if so, the extent to which they could be achieved with a system that imposes less regulation.

• (3) “Review period” means—

• (a) the period of five years beginning with 1st April 2012; and

• (b) subject to paragraph (4), each successive period of five years.

• (4) If a report under this regulation is laid before Parliament before the last day of the review period to which it relates, the following review period is to begin with the day on which the report is laid.

Energy Act 2013

• (1) Paragraph 2 of Schedule 9 to the Energy Act 2013 (prohibition on disclosing protected information) does not apply to the disclosure of information by the Office for Nuclear Regulation to another responder if the disclosure is made—

• (a) in connection with the performance by that other responder of a duty under—

• (i) section 2 or 4;

• (ii) a provision of these Regulations; or

• (iii) a provision in regulations made by the Scottish Ministers under Part 1;

• (b) in connection with another function of that responder which relates to emergencies; or

• (c) in connection with a function of the Office for Nuclear Regulation which relates to emergencies.

• (2) For the purposes of paragraph (1), it is immaterial whether the disclosure is made pursuant to a request made under regulation 47.

• (3) In paragraph (1), the reference to the Office for Nuclear Regulation includes a reference to an officer of the Office.
