The Secretary of State, being a Minister designated[^f00001] for the purposes of section 2(2) of the European Communities Act 1972[^f00002] in relation to measures relating to noise emission in the environment by equipment for use outdoors, in exercise of the powers conferred on him by that section, makes the following Regulations:

Citation and commencement

These Regulations may be cited as the Noise Emission in the Environment by Equipment for Use Outdoors (Amendment) Regulations 2005 and shall come into force on 3rd January 2006.

Amendment to the Noise Emission in the Environment by Equipment for Use Outdoors Regulations 2001

The Noise Emission in the Environment by Equipment for Use Outdoors Regulations 2001[^f00003] are amended by substituting for the table in Schedule 3 the table set out in the Schedule to these Regulations.

Explanatory note

(This note is not part of the Regulations)

These Regulations amend the Noise Emission in the Environment by Equipment for Use Outdoors Regulations 2001 (S.I. 2001/1701), as amended by S.I. 2001/3958.

These Regulations implement European Parliament and Council Directive 2005/88/EC (OJ No. L344, 27.12.2005, p44) which amends European Parliament and Council Directive 2000/14/EC (OJ No. L162, 3.7.2000, p1) on the approximation of the laws of the Member States relating to the noise emission in the environment by equipment for use outdoors.

The table in these Regulations amends the sound power limits for the following categories of equipment—

A Regulatory Impact Assessment and a Transposition Note have been prepared.
