The Secretary of State, in exercise of the powers conferred upon him by sections 38(1)(b), 52(1)(b) and (7)(a), 315(2) and (5) and 318(1) of the Pensions Act 2004 , by this instrument, which contains regulations made before the end of the period of six months beginning with the coming into force of the provisions of that Act by virtue of which they are made , makes the following Regulations:

Citation and commencement

These Regulations may be cited as the Pensions Regulator (Contribution Notices and Restoration Orders) Regulations 2005 and shall come into force on 6th April 2005.

Person of a prescribed description

A person who is prescribed for the purposes of section 52(7)(a) is any person whom the trustees or managers of the scheme have authorised to enter into transactions involving the assets of that scheme.
