The Secretary of State, being a Minister designated for the purposes of section 2(2) of the European Communities Act 1972 in relation to measures relating to rights of entry into, and residence in, the United Kingdom, in exercise of the powers conferred upon him by that section, and of the powers conferred on him by section 109 of the Nationality, Immigration and Asylum Act 2002 , makes the following Regulations:

PART 1 — INTERPRETATION ETC

Citation and commencement

These Regulations may be cited as the Immigration (European Economic Area) Regulations 2006 and shall come into force on 30th April 2006.

General interpretation

Continuity of residence

“Worker”, “self-employed person”, “self-sufficient person” and “student”

“Worker or self-employed person who has ceased activity”

shall be treated as periods of activity as a worker or self-employed person, as the case may be.

“Qualified person”

unless the person concerned has, since enjoying the above right to reside, been continuously absent from the United Kingdom for at least 12 months.
