Section 57(1) of the Scotland Act 1998 (c. 46) provides that despite the transfer to the Scottish Ministers of functions in relation to observing and implementing obligations under Community law by virtue of that Act, any function of a Minister of the Crown shall continue to be exercisable by him as regards Scotland for the purposes specified in section 2(2) of the European Communities Act 1972.

By virtue of Article 3(1) of the National Assembly for Wales (Transfer of Functions) Order 2005 (S.I. 2005/1958), the functions of the Secretary of State under section 2 of this Act were transferred to the National Assembly for Wales so far as they are exercisable in relation to Wales except in relation to offshore oil and gas exploration and exploitation. Regulation 11 of these regulations is the only part of these regulations made under that power, and relates solely to installations for the offshore exploration and exploitation of oil and gas.
