Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order amends the East Kent Hospitals National Health Service Trust (Establishment) Order 1999 (“the Establishment Order”), which established the East Kent Hospitals National Health Service Trust.

Article 3 of the Order changes the name of the trust from the East Kent Hospitals National Health Service Trust to the East Kent Hospitals University National Health Service Trust and makes consequential amendments to the Establishment Order.

Article 4 amends the provision of the Establishment Order which specifies the nature and functions of the trust, so as to replace the reference to section 5 of the National Health Service and Community Care Act 1990 (which has been repealed and is replaced by section 25 of the National Health Service Act 2006) and remove the reference to the particular establishments and facilities from which the trust carries out its functions.

Article 5 increases the number of non-executive directors the trust must have from 6 to 7 and provides that one of the non-executive directors of the trust must be appointed from King’s College (University of London).
