The Secretary of State for Environment, Food and Rural Affairs, being a Minister designated for the purposes of section 2(2) of the European Communities Act 1972 in relation to measures relating to the control and regulation of genetically modified organisms, makes the following Regulations in exercise of the powers conferred by that section.

Title and commencement

These Regulations may be cited as the Genetically Modified Organisms (England) (Amendments) Regulations 2008; they come into force on 14th November 2008.

Amendments

In regulation 8(1) of the Genetically Modified Organisms (Traceability and Labelling) (England) Regulations 2004 —

In regulation 8(1) of the Genetically Modified Organisms (Transboundary Movements) (England) Regulations 2004 , for sub-paragraph (d) substitute—

(d) without reasonable excuse to fail to comply with the requirements of a notice issued under regulation 7;
