Made: 11th February 2009
In accordance with section 172(5)(a) of that Act, the Secretary of State has consulted with the Department of Health, Social Services and Public Safety in Northern Ireland.
Citation and interpretation

- (1) This Order may be cited as the Health and Social Care Act 2008 (Commencement No.8) Order 2009.
- (2) In this Order “the Act” means the Health and Social Care Act 2008.
Appointed day in respect of provisions relating to the Health Protection Agency Act 2004

- (1) 1st March 2009 is the appointed day for the coming into force of paragraph (a) of subsection (5) of section 159 of the Act.
- (2) 1st April 2009 is the appointed day for the coming into force of the following provisions of the Act —
- (a) section 159 in so far as it is not already in force; and
- (b) Part 7 of Schedule 15 (abolition of National Biological Standards Board) and in so far as it relates to that Part, section 166 (repeals) of the Act.

Explanatory note
(This note is not part of the Order)
EXPLANATORY NOTE
Article 2 (1) of this Order brings into force on 1st March 2009 paragraph (a) of subsection (5) of section 159 of the Health and Social Care Act 2008 which will enable the Secretary of State to make a scheme for the transfer of property from the National Biological Standards Board to the Health Protection Agency.
Article 2 (2) of this Order brings into force section 159 in so far as it is not already in force and related consequential repeals. Section 159, in particular, abolishes the National Biological Standards Board and amends the Health Protection Agency Act 2004[^f00002] in relation to the functions of the Health Protection Agency in relation to biological substances.
An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
