The Secretary of State is designated[^f00001] for the purposes of section 2(2) of the European Communities Act 1972[^f00002] in relation to the common agricultural policy of the European Community and in exercise of the powers conferred by that section, makes the following Regulations.

Citation, commencement and application

These Regulations may be cited as the Animals (Divisional Veterinary Managers) Regulations 2009; they apply in England and come into force on 1st November 2009.

Amendments to the Products of Animal Origin (Import and Export) Regulations 1996

  • (1) The Products of Animal Origin (Import and Export) Regulations 1996[^f00003] are amended in accordance with this regulation.
  • (2) In regulation 1(2) delete the definition of “Divisional Veterinary Manager”.
  • (3) In regulations 13(5) and (6) and 16(8), for the words “the appropriate Divisional Veterinary Manager”, in each place that they occur, substitute “the Secretary of State”.

Amendment to the Foot-and-Mouth Disease (Control of Vaccination) (England) Regulations 2006

  • (1) The Foot-and-Mouth Disease (Control of Vaccination) (England) Regulations 2006[^f00004] are amended in accordance with this regulation.
  • (2) In regulation 2(1) delete the definition of “Divisional Veterinary Manager”.
  • (3) In regulations 21(4) and 23(1) for the words “Divisional Veterinary Manager” substitute the words “Secretary of State”.

Amendment to the Avian Influenza (Preventive Measures) (England) Regulations 2006

In regulation 13 of the Avian Influenza (Preventive Measures) (England) Regulations 2006[^f00005], for “the Divisional Veterinary Manager appointed by the Secretary of State for the area in which the bird is located” substitute “the Secretary of State”.

Amendment to the Avian Influenza (Vaccination) (England) Regulations 2006

In regulation 11 of the Avian Influenza (Vaccination) (England) Regulations 2006[^f00006], for “Divisional Veterinary Manager appointed by the Secretary of State for the area in which that bird is located” substitute “Secretary of State”.

Amendment to the Bluetongue Regulations 2008

  • (1) The Bluetongue Regulations 2008[^f00007] are amended in accordance with this regulation.
  • (2) Regulation 8(3) is revoked.
  • (3) In regulations 8(1)(a) and (2) and 11(b) for the words “Divisional Veterinary Manager” substitute the words “Secretary of State”.

EXPLANATORY NOTE

These Regulations replace references to “Divisional veterinary manager” with references to “the Secretary of State” in—

  • (a) the Products of Animal Origin (Import and Export) Regulations 1996
  • (b) the Foot-and-Mouth Disease (Control of Vaccination) (England) Regulations 2006
  • (c) the Avian Influenza (Preventive Measures) (England) Regulations 2006
  • (d) the Avian Influenza (Vaccination) (England) Regulations 2006
  • (e) the Bluetongue Regulations 2008

An impact assessment has not been prepared for these Regulations, as no impact on the private, public or voluntary sector is foreseen.
