Coming into force: 1st November 2009

The Secretary of State makes this Order in exercise of the powers conferred by sections 1, 15(4) and 83(2) of the Animal Health Act 1981[^f00001].

Citation, application and commencement

This Order may be cited as the Animal Health (Divisional Veterinary Managers) Order 2009; it applies in England and comes into force on 1st November 2009.

The Infectious Diseases of Horses Order 1987[^f00004] is amended by omitting the Notes to Forms A, B, C and D in Schedule 1.

Amendment to the Foot-and-Mouth Disease (England) Order 2006

(5) Where notification is received under this article from a person other than the occupier of the premises where the relevant animal or carcase is located, a veterinary inspector may serve a notice on the occupier informing the occupier that— (a) notification has been received under this article; and (b) Schedule 1 applies in relation to the premises.

Amendment to the Avian Influenza and Influenza of Avian Origin in Mammals (England) (No. 2) Order 2006

Article 9 (4) of the Avian Influenza and Influenza of Avian Origin in Mammals (England) (No.2) Order 2006[^f00007] is omitted.

Revocation

The Animal Health Orders (Divisional Veterinary Manager Amendment) Order 1995 is revoked[^f00008].

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order amends specified Orders to remove references to “Divisional Veterinary Manager” and replaces those references with “Secretary of State”. This Order also revokes definitions of “Divisional Veterinary Manager” in all affected Orders.

An impact assessment has not been prepared for this Order, as no impact on the private, public or voluntary sector is foreseen.

[^f00001]: 1981 c. 22. Powers to make Orders under these sections were originally conferred on “the Ministers” by section 86 of the Act. These powers are now exercisable by the Secretary of State. Functions of “the Ministers” were transferred, so far as exercisable by the Secretaries of State for Scotland and Wales, to the Minister of Agriculture, Fisheries and Food by the Transfer of Functions (Agriculture and Food) Order 1999 (S.I. 1999/3141). Functions of the Minister of Agriculture, Fisheries and Food were then further transferred to the Secretary of State by the Ministry of Agriculture, Fisheries and Food (Dissolution) Order 2002 (S.I. 2002/794).
