Now, therefore, Their Lordships, having taken these Rules into consideration, are pleased to, and do hereby approve them.

This Order may be cited as the General Medical Council (Constitution of Panels and Investigation Committee) (Amendment) Rules Order of Council 2009, and shall come into force on 16th November 2009.

SCHEDULE — THE GENERAL MEDICAL COUNCIL (CONSTITUTION OF PANELS AND INVESTIGATION COMMITTEE) (AMENDMENT) RULES 2009

The General Medical Council, in exercise of its powers under paragraphs 19A to 19E and 23B of Schedule 1 to the Medical Act 1983 hereby makes the following rules:

Citation and commencement

These Rules may be cited as the General Medical Council (Constitution of Panels and Investigation Committee) (Amendment) Rules 2009, and shall come into force on 16 November 2009.

Amendments

In the General Medical Council (Constitution of Panels and Investigation Committee) Rules 2004[^f00003]—

• (1) In rule 2, for the definition of “lay”, substitute the following: “means a person who is not and never has been provisionally or fully registered, was at no time registered with limited registration and does not hold qualifications which would entitle them to apply for provisional or full registration under the Act”.

• (2) In rules 3(1)(a)(ii), 3(2), 4(2), 4(3), 5(1)(a)(ii), 5(2)(b), 6 and 7, for “Registration Decisions Panel” substitute “Registration Panel”.

Explanatory note

EXPLANATORY NOTE

The Rules approved by this Order make minor changes to rules 2, 3, 4, 5, 6 and 7, of the General Medical Council (Constitution of Panels and Investigation Committee) Rules 2004.

They update terminology of the Rules in line with the provisions of the Medical Act 1983 as amended by the Medical Act (Amendment) Order 2002 (SI 2002/3135), the Medical Act (Amendment) and Miscellaneous Amendments Order 2006 (SI 2006/1914) which substituted “Registration Panels” for “Registration Decision Panels”, and the Health Care and Associated Professions (Miscellaneous Amendments) Order 2008 (SI 2008/1774) which inserted provisions as to the constitution of the General Medical Council concerning lay members, the description of which is introduced into these Rules.
