The Carbon Accounting (Amendment) Regulations 2009

Before making of these Regulations, the Secretary of State consulted the Scottish Ministers, the Welsh Ministers and the Department of the Environment in Northern Ireland, in accordance with section 28(4)(b) of the Act[^f00002].

Citation and commencement

These Regulations may be cited as the Carbon Accounting (Amendment) Regulations 2009 and come into force on 1st January 2010.

Amendment of the Carbon Accounting Regulations 2009

• (1) The following amendments are made to regulation 6 (crediting and debiting of carbon units as a result of the operation of the EU ETS during the 2008-2012 budgetary period) of the Carbon Accounting Regulations 2009[^f00003].

• (2) In paragraphs (3), (4), (5) and (6) for “245,991,207” substitute “the annual allocation”.

• (3) After paragraph (6) insert—

(7) For the purposes of regulation 6 “the annual allocation” means— (a) 245,991,207 carbon units in respect of 2008; (b) 245,294,083 carbon units in respect of 2009 and 2010; (c) 245,294,084 carbon units in respect of 2011 and 2012.

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

These Regulations amend an error in regulation 6 of the Carbon Accounting Regulations 2009. They adjust the annual amount of carbon units to be used in determining the amount of units to be credited to or debited from the net UK carbon account as a result of the operation of the European Union Emissions Trading Scheme. This ensures that the annual amounts add up to the UK allocation under the European Union Emissions Trading Scheme for the period 2008-2012.

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
