Made: 7th December 2009

The Secretary of State, in exercise of the power conferred by section 200(5) of the 1992 Act, makes the following Order:

Citation

This Order may be cited as the Employment Protection Code of Practice (Time Off for Trade Union Duties and Activities) Order 2009.

Appointed day for the Code of Practice

The day appointed by the Secretary of State under section 200(5) of the Trade Union and Labour Relations (Consolidation) Act 1992 for the coming into effect of the Code of Practice on Time Off for Trade Union Duties and Activities issued by the Advisory, Conciliation and Arbitration Service pursuant to that section is 1st January 2010.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order appoints 1st January 2010 as the day upon which the revised Code of Practice on Time Off for Trade Union Duties and Activities will come into effect. The Code of Practice, which includes guidance on time off for union learning representatives, is being issued by the Advisory, Conciliation and Arbitration Service under section 200(3) and section 199(1) and (4) of the Trade Union and Labour Relations (Consolidation) Act 1992.

The Code of Practice replaces the Code of Practice on Time Off for Trade Union Duties and Activities which came into effect on 27th April 2003.

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
