The Education and Skills Act 2008 (Commencement No. 5) Order 2009

The Secretary of State for Children, Schools and Families makes the following Order in exercise of the powers conferred by section 173(4) and (8) of the Education and Skills Act 2008[^f00001]:

This Order may be cited as the Education and Skills Act 2008 (Commencement No. 5) Order 2009.

Provisions coming into force on 12th January 2009

Section 79 of the Education and Skills Act 2008 comes into force on 12th January 2010 so far as not already in force.

Explanatory note

EXPLANATORY NOTE

This is the fifth commencement order made by the Secretary of State under the Education and Skills Act 2008 (“the Act”).

Article 2 commences on 12th January 2010, section 79 so far as not already in force. Section 79 repeals sections 114 to 121 of the Learning and Skills Act 2000 which provided for the establishment of the service known as the “Connexions service”. The effect of this Order is to commence repeals of sections 114(1) and (4), 117, 119 and 120. The repeals in section 79 are part of a number of provisions set out in the Education and Skills Act 2008 which devolve the responsibility for delivering the Connexions service to local education authorities.
