The Allocation and Transfer of Proceedings (Amendment) Order 2009

Coming into force: 1st February 2010
The Lord Chancellor, after consulting the Lord Chief Justice, makes the following Order in exercise of the powers conferred by section 92(6) and Part 1 of Schedule 11 to the Children Act 1989[^f00001].
Citation and Commencement

This Order shall be cited as the Allocation and Transfer of Proceedings (Amendment) Order 2009 and shall come into force on 1st February 2010.
Revocation of Jurisdiction

Nelson County Court shall cease to be a family hearing centre.
Amendments to the Allocation and Transfer of Proceedings Order 2008

The Allocation and Transfer of Proceedings Order 2008[^f00002] shall be amended by deleting the entry in Schedule 1 to that Order relating to Nelson County Court.

Explanatory note
(This note is not part of the Order)
EXPLANATORY NOTE
This Order amends the Allocation and Transfer of Proceedings Order 2008 so as to remove the jurisdiction of Nelson County Court as a family hearing centre. It does not deal with the devolution of the business of Nelson County Court but this is transferred to Burnley County Court by direction of the Lord Chancellor after consulting with the Lord Chief Justice. By virtue of a judicial direction, Burnley County Court will have jurisdiction in proceedings commenced in Nelson County Court before the coming into force of this Order.
