Laid before Parliament: 21st December 2009

Coming into force: 1st February 2010

In accordance with section 33(1) of the Matrimonial and Family Proceedings Act 1984 the Lord Chief Justice concurs in the making of this Order to the extent that it applies to matrimonial jurisdiction.

Citation and commencement

This Order may be cited as the Civil Courts (Amendment No. 2) Order 2009 and shall come into force on 1st February 2010.

Closure of Nelson County Court

Nelson County Court shall cease to be held.

Amendments to the Civil Courts Order 1983

The Civil Courts Order 1983[^f00003] shall be amended by deleting the entries in Schedule 3 relating to Nelson County Court.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order amends the Civil Courts Order 1983 so as to close the Nelson County Court. It does not deal with the devolution of the business of Nelson County Court but this is transferred to Burnley County Court by direction of the Lord Chancellor after consulting with the Lord Chief Justice. By virtue of judicial direction, Burnley County Court will have jurisdiction in proceedings commenced in Nelson County Court before the coming into force of this Order.
