Their Lordships make the following Order of Council in exercise of the powers conferred by article 1(5) of the Health Care and Associated Professions (Miscellaneous Amendments) Order 2008[^f00001].

This Order may be cited as the Health Care and Associated Professions (Miscellaneous Amendments) Order 2008 (Commencement No. 2) (Amendment) Order of Council 2009.

Amendment of the Health Care and Associated Professions (Miscellaneous Amendments) Order 2008 (Commencement No. 2) Order of Council 2008

In article 2 of the Health Care and Associated Professions (Miscellaneous Amendments) Order 2008 (Commencement No. 2) Order of Council 2008[^f00002] (appointed days), in paragraph (3), for sub-paragraph (c) substitute the following sub-paragraph—

(c) paragraphs 3(1) and (2) and 4 of Schedule 5 to the principal Order, and article 3(2) of the principal Order in so far as it relates to those paragraphs.

Explanatory note

EXPLANATORY NOTE

This Order corrects an error in the Health Care and Associated Professions (Miscellaneous Amendments) Order 2008 (Commencement No. 2) Order of Council 2008 (“the principal Order”), which brought into force the repeal of The General Optical Council (Committee Constitution Rules) Order of Council 2005[^f00003] (“the 2005 Order”) on 1st April 2009 by mistake.

The principal Order, amongst other matters, brings into force changes to the constitutional arrangements of the General Optical Council and its statutory committees. However, the Rules scheduled to the 2005 Order have in fact been amended, rather than being repealed, as part of the programme of revision of those constitutional arrangements – the amendments are scheduled to the General Optical Council (Committee Constitution) (Amendment) Rules Order of Council 2008[^f00004]. The commencement of the repeal of the 2005 Order has therefore needed to be removed from the principal Order.
