The Charities Act 2006 (Commencement No. 5, Transitional and Transitory Provisions and Savings) (Amendment) Order 2010

The Minister for the Cabinet Office makes the following Order in exercise of the powers conferred by sections 78(6) and 79(2) and (3) of the Charities Act 2006[^f00001]:

This Order may be cited as the Charities Act 2006 (Commencement No. 5, Transitional and Transitory Provisions and Savings) (Amendment) Order 2010.
Amendment of the Charities Act 2006 (Commencement No. 5, Transitional and Transitory Provisions and Savings) Order 2008

- (1) The Charities Act 2006 (Commencement No. 5, Transitional and Transitory Provisions and Savings) Order 2008[^f00002] is amended as follows.
- (2) In Articles 1, 6, 11, 19, 24 and 26 for “1st September 2010”, in each place, substitute “1st September 2011”.

EXPLANATORY NOTE
This Order further amends the transitional and transitory provisions and savings made in the Charities Act 2006 (Commencement No. 5, Transitional and Transitory Provisions and Savings) Order 2008 (S.I. 2008/3267 (C.150), amended by S.I. 2009/2648 (C.118)). The effect is that, notwithstanding their removal from Schedule 2 to the Charities Act 2003 with effect from 31 January 2009, the following will continue to be treated as if they were exempt charities until 1st September 2011, instead of 1st September 2010:
- (a) bodies to which section 23(1)(a) or (b) of the School Standards and Framework Act 1998 applies; and
- (b) institutions to which section 23(2) of that Act applies.
