EXPLANATORY NOTE
This Order revokes and replaces with amendments the Smoke Control Areas (Exempted Fireplaces) (England) Order 2010 (S.I. 2010/577).
It exempts the fireplaces listed in the Schedule from the provisions of section 20 of the Clean Air Act 1993 (prohibition of smoke emissions in smoke control areas), subject to the conditions set out in the Schedule. Several additional fireplaces have been exempted.
No impact assessment has been produced for this instrument as no impact on business, the private or voluntary sectors is foreseen.
