The Equality Act 2010 (Qualifying Compromise Contract Specified Person) Order 2010

The Secretary of State makes the following Order in exercise of the powers conferred by sections 147(4)(d) and 207(1) of the Equality Act 2010[^f00001]:

Citation and commencement

This Order may be cited as the Equality Act 2010 (Qualifying Compromise Contract Specified Person) Order 2010 and comes into force on 1st October 2010.

Person specified

For the purpose of section 147(4)(d) of the Equality Act 2010, a Fellow of the Institute of Legal Executives practising in a solicitor’s practice (including a recognised body under section 9(1) of the Administration of Justice Act 1985[^f00002]) is specified.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order extends the category of person capable of acting as an independent adviser whose advice is necessary to establish a qualifying compromise contract under Part 10 of the Equality Act 2010 (“the Act”) to a Fellow of the Institute of Legal Executives practising in a solicitor’s practice including an incorporated practice recognised by the Law Society under section 9(1) of the Administration of Justice Act 1985.

A full impact assessment of the effect that the Act will have on the costs to business and the voluntary sector is available at the Government Equalities Office website at www.equalities.gov.uk. A further impact assessment has not been produced for this instrument as no additional impact on the private or voluntary sectors is foreseen.
