The Secretary of State for Education makes the following Order in exercise of the powers conferred by section 3(2)(b) and (3)(b) of the Safeguarding Vulnerable Groups Act 2006[^f00001]:

This Order may be cited as the Safeguarding Vulnerable Groups Act 2006 (Specified Lists: Scotland) Order 2010 and comes into force on 30th November 2010.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order is made under the Safeguarding Vulnerable Groups Act 2006 (“the Act”). Article 2 of the Order specifies that the children’s list and the adults’ list maintained by the Scottish Ministers under the Protection of Vulnerable Groups (Scotland) Act 2007 correspond respectively to the children’s barred list and the adults’ barred list maintained under the Act. Section 3 of the Act provides that a person included in a specified list is barred under from regulated activity (as defined in Schedule 4 to the Act) relating to the relevant group.

An impact assessment has not been produced for this instrument as no impact on the private, voluntary or public sectors is foreseen.

[^f00001]: 2006 c. 47 (“the Act”). Section 3 of the Act provides that a person is barred from regulated activity if the person is included in a list maintained under the law of Scotland or Northern Ireland which the Secretary of State specifies by order as corresponding to the relevant barred list maintained under section 2 of the Act. Section 61(1) of the Act provides that a power under the Act to make orders is exercisable by statutory instrument.
