The Highway Litter Clearance and Cleaning (Transfer of Responsibility) (England) (Amendment) Order 2010

Coming into force: 8th November 2010
In accordance with paragraphs (b) and (c) of that section, the Secretary of State consulted with the relevant local authorities prior to making type=start slip=2011-10-01 time=1318256030350the Highway Litter Clearancetype=end slip=2011-10-01 time=1318256030350 and Cleaning (Transfer of Responsibility) (England) Order 2009[^f00002], and it appeared to him to be necessary or expedient to make an Order under that section in order to prevent or minimise interference with the passage or with the safety of traffic along the highway. The Secretary of State is satisfied that the requirement for consultation in respect of this Order is met by the consultation undertaken on that Order.
Citation, application and commencement

This Order—
- (a) may be cited as the Highway Litter Clearance and Cleaning (Transfer of Responsibility) (England) (Amendment) Order 2010;
- (b) applies to England; and
- (c) comes into force on 8th November 2010.
Amendments to the 2009 Order

- (1) In the Highway Litter Clearance and Cleaning (Transfer of Responsibility) (England) Order 2009, column 2 of the Schedule is amended in accordance with the following paragraphs.
- (2) In relation to the third item, insert the words “to the boundary between the Borough of Elmbridge” before the words “and the Royal Borough of Kingston upon Thames”.
- (3) In relation to the fifth item, insert the words “and the Borough of Runnymede to the boundary between the Royal Borough of Windsor and Maidenhead” before the words “and the Borough of Spelthorne”.
- (4) In relation to the first sentence (referring to the A30) of the sixth item, insert the words “and the Royal Borough of Windsor and Maidenhead to the boundary between the Borough of Spelthorne” before the words “and the London Borough of Hounslow”.
- (5) In relation to the fourteenth item, for “at the junction” substitute “to the junction”.

Explanatory note

EXPLANATORY NOTE
This Order amends the Highway Litter Clearance and Cleaning (Transfer of Responsibility) (England) Order 2009 to correct some drafting errors.
This Order inserts further wording into column 2 of the Schedule to that Order, at the third, fifth, sixth and fourteenth items. This is to provide clarity as to the descriptions of the parts of the highways for which responsibility for the discharge of the litter clearance and cleaning duties is transferred to the Secretary of State for Transport.
An impact assessment has not been produced for this instrument as no impact on the costs of the private, public or voluntary sector is foreseen.
