Coming into force in accordance with article 1

The Secretary of State for Transport makes this Instrument in exercise of powers conferred by section 106(3) of the Highways Act 1980[^f00001] and now vested in the Secretary of State[^f00002]:

This Instrument may be cited as “The Cornwall Council (Hayle North Quay) Bridge Scheme 2010 Confirmation Instrument 2010 ” and shall come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

The Cornwall Council (Hayle North Quay) Bridge Scheme 2010 (“the Scheme”) is hereby confirmed without modifications.

The Scheme as confirmed is set out in the Schedule hereto (including the plan) and copies of the Scheme with its accompanying plan are deposited at the offices of the Department for Transport, Floor 13 (IMD), Ashdown House, StLeonards on Sea, Hastings, East Sussex, TN37 7GA, and at the offices of the Cornwall Council at New County Hall, Treyew Road, Truro, Cornwall, TR1 3AY; and the Penzance Offices, St Clare, Penzance, Cornwall TR18 3QW.

THE SCHEDULE — THE CORNWALL COUNCIL (HAYLE NORTH QUAY) BRIDGE SCHEME 2010

The Cornwall Council (hereinafter referred to as “the Council”) make this scheme in exercise of their powers under section 106(3) of the Highways Act 1980 and of all other powers enabling them in that behalf.

1 The Council are authorised to construct over the navigable waters of Hayle Harbour the bridge specified in the schedule to this Scheme as part of the highway they are proposing to construct between Merchant Curnows Quay, Copperhouse, Hayle and the Renewable Energy Business Park, Hayle Habour, Cornwall.

2 This Scheme may be cited as The Cornwall Council (Hayle North Quay) Bridge Scheme 2010. Given under the common seal of the Council on the 10 day of August 2010. Executed as a deed by THE CORNWALL COUNCIL Whose Common Seal was Hereunto affixed in the Presence of:- J Broadway Authorised Officer

THE SCHEDULE TO THE SCHEME — PLANS AND SPECIFICATIONS OF THE HAYLE NORTH QUAY BRIDGE

The location and general design of the Bridge are shown on the attached plan and marked “The Cornwall Council (Hayle North Quay) Bridge Scheme 2010” sealed with the Common Seal of the Council and deposited at the offices of Cornwall Council, County Hall, Treyew Road, Truro, Cornwall, TR1 3AY and at the Department for Transport, Local Authority Orders, Wellbar House, Gallowgate, Newcastle Upon Tyne, NE1 4TD.

EXPLANATORY NOTE

This instrument confirms a scheme to construct a bridge over the navigable waters of Hayle Harbour across Copperhouse Pool, a bridge, to provide access to North Quay, Hayle, Cornwall.
