The Buckinghamshire Hospitals National Health Service Trust (Trust Funds: Appointment of Trustees) Order 2010

Coming into force: 10th March 2010

The Secretary of State for Health makes the following Order in exercise of the powers conferred by sections 272(7) and (8) of, and paragraph 10 of Schedule 4 to, the National Health Service Act 2006[^f00001].

Citation, commencement and interpretation

• (1) This Order may be cited as the Buckinghamshire Hospitals National Health Service Trust (Trust Funds: Appointment of Trustees) Order 2010 and shall come into force on 10th March 2010.

• (2) In this Order—

• “the Act” means the National Health Service Act 2006;

• “the Trust” means the Buckinghamshire Hospitals National Health Service Trust[^f00002].

Appointment of trustees

• (1) The Secretary of State shall appoint trustees for the Trust for the purpose of exercising the functions described in paragraph 10(1) of Schedule 4 to the Act (trust funds and trustees).

• (2) A trustee shall be appointed for such period, not exceeding 4 years, as the Secretary of State may specify on making the appointment.

Termination and suspension of appointment

• (1) The Secretary of State may terminate a trustee’s tenure of office where the Secretary of State is of the opinion that it is not in the interests of the Trust or the health service or the administration of any trust funds that the trustee should continue to hold office.

• (2) Where the Secretary of State is of the opinion referred to in paragraph (1), the Secretary of State may suspend the trustee from office, pending a decision on whether to terminate the trustee’s tenure of office.

EXPLANATORY NOTE

This Order provides for the Secretary of State to appoint trustees for the Buckinghamshire Hospitals National Health Service Trust to hold trust property for the purposes of the Trust or for any other purpose relating to the National Health Service, and for their removal or suspension from office.
