The Secretary of State, in exercise of the powers conferred by section 5(1) and (2) of, and paragraphs 1 and 2 of Schedule 3 to, the Public Expenditure and Receipts Act 1968[^f00001] and now vested in him[^f00002], makes the following Order:
Citation, commencement and interpretation

- (1) This Order may be cited as the Registration of Births, Deaths and Marriages (Fees) Order 2010 and shall come into force on 6th April 2010.
- (2) In this Order-
- (a) a reference to a numbered column is to the column in the Schedule to this Order bearing that number;
- (b) the “1949 Act” means the Marriage Act 1949[^f00003];
- (c) the “1953 Act” means the Births and Deaths Registration Act 1953[^f00004];
- (d) a “priority service” in column (3) is a service in respect of a matter or case specified in column (3) provided to a person who, by paying the corresponding fee in column (4) and giving the relevant information, makes an application to the Registrar General by 1600hours on any working day and which is normally provided on or before the next working day by sending by first class post or to a person attending in person at the General Register Office between 1000 hours and 1600 hours;
- (e) a “standard service” in column (3) is a service in respect of a matter or case specified in column (3) provided to a person who, by paying the corresponding fee in column (4) and giving the relevant information, makes an application to the Registrar General by 1600hours on any working day and which is normally provided either –
- (i) in a case where that application includes a reference number relating to an index kept by the Registrar General under section 65(1) of the 1949 Act or section30(1) or (1A)[^f00005] of the 1953 Act on or before the 4th working day after the working day on which such application is made; or
- (ii) in a case where that application does not include such a reference number on or before the 15thworking day after the working day on which such application is made
by sending by second class post or to a person attending in person at the General Register Office between 1000 hours and 1600 hours;
- (f) “relevant information” means-
- (i) in the case of a short certificate of birth provided under section 33(1) of the 1953Act, the particulars prescribed by Regulation 63 of the Registration of Births and Deaths Regulations 1987[^f00006]; and
- (ii) in the case of a certified copy of an entry provided under section 65(2) of the 1949Act or section 30(2) of the 1953 Act, either a reference number relating to an index kept by the Registrar General under section 65(1) of the 1949 Act or section 30(1) or (1A) of the 1953 Act corresponding to the certified copy for which the application is made, or sufficient information which allows the Registrar General to establish such reference number; and
- (g) “working day” means a day which is not a Saturday or a Sunday, Christmas Day, Good Friday or a bank holiday under the Banking and Financial Dealings Act 1971[^f00007] in England and Wales.
Fees payable

In each enactment specified in column (2) in relation to which there is an entry in column (5), for the sum specified in column (5) there is substituted the sum specified in relation to it in column (4); and the fee payable in England and Wales under each of the enactments specified in column (2) in respect of a matter or case specified in column (3) is that specified in relation to that matter or case in column (4).
Revocations

The Registration of Births, Deaths and Marriages (Fees) Order 2002[^f00008] and the Registration of Births, Deaths and Marriages (Fees) (Amendment) Order 2005[^f00009] are revoked.

Explanatory note
(This note is not part of the Order)
EXPLANATORY NOTE
This Order specifies the fees payable under the Acts relating to the registration of birth, deaths and marriages and associated matters from 6th April 2010. Where fees have been increased, the fees payable both before and after that date are set out in the Schedule.
Two different types of service, set out in column (3) of the Schedule, are available in respect of the provision of a certified copy of entry obtained from the Registrar General following a search of indexes kept at the General Register Office under section 65(2)(c) of the Marriage Act 1949 or section 30(2)(c) of the Births and Deaths Registration Act 1953, and the provision of a short certificate of birth obtained from the Registrar General where that certificate is compiled from a certified copy of an entry in the register of live-births, or from any other records and registers in the custody of the Registrar General, under section 33(1) of the Births and Deaths Registration Act1953.
A “priority service” is a service under which a person may apply to the Registrar General by 1600hours on any working day and the certified copy of entry, or short certificate of birth as the case may be, will normally be provided to that person on or before the following working day by sending by first class post or between 1000 hours and 1600 hours where he attends at the General Register Office in person. A “standard service” is a service under which a person may apply to the Registrar General by 1600 hours on any working day and the certified copy of entry, or short certificate of birth as the case may be, will normally be provided to that person by sending by second class post or between 1000 hours and 1600 hours where he attends at the General Register Office in person either – (i) on or before the 4th working day after the working day on which the application was made where a reference number which relates to an index kept by the Registrar General under section 65(1) of the Marriage Act 1949 or section 30(1) or (1A) of the Births and Deaths Registration Act 1953 has been provided with that application; or (ii) on or before the15thworking day after the working day on which the application was made where such a reference number is not provided. A working day in this context excludes a Saturday or Sunday, Christmas Day, Good Friday, and a bank holiday under the Banking and Financial Dealings Act1971 in England and Wales.
A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
